Top criminal barristers Sasha Wass QC and Jeremy Dein QC re-examine the case of an off-duty soldier who was convicted of murdering a family friend on New Year’s Eve.

Bishop Auckland, County Durham, 1934. Whilst the country was revelling on New Year’s Eve, a brutal murder was taking place in a suburban terraced house. Solicitor’s clerk Edward Frederick Herdman was at home when he was ferociously attacked with a fire poker and his throat slit with his own pocketknife. The motive seemed to be robbery.

Police quickly tracked down a man who was known to have been in Herdman’s company earlier that day, 25-year-old family friend and soldier John Stephenson Bainbridge. Bainbridge had called at the house to ask Herdman to draw up a will amid rumours that his regiment was shortly to be stationed abroad.

Season 3, Episode 09 –
Leading criminal barristers Sasha Wass and Jeremy Dein investigate the fatal poisoning of a 49-year-old wealthy lodger at a family mansion.

London, 1911. Insurance salesman Frederick Seddon arranged a hasty funeral for his tenant, spinster Eliza Barrow, who had, it was initially believed, died from diarrhoea and exhaustion after a brief illness. Miss Barrow's relatives were shocked to discover not only that the family had not been informed, but that Eliza had signed over her extensive assets of East India trading stock and property to the landlord she had known for less than a year in the belief that he would look after her recently adopted 10-year-old son, Ernest Grant.

Eliza's body was exhumed and found to contain fatal levels of arsenic. Frederick Seddon and his wife Margaret were arrested and charged. Seddon claimed Miss Barrow accidentally killed herself by consuming the poison from flypaper in her living quarters. Mrs Seddon was acquitted and returned to the couple's five children, but in March 1912 Frederick Seddon was convicted of murder at the Old Bailey and sentenced to death. But was this a miscarriage of justice based on circumstantial evidence and a questionable motive?

Now, 107 years later, Frederick Seddon's relative Paul wants to learn if the controversy associated with his family is justified. Was Frederick Seddon capable of murder?

Sasha and Jeremy explore the toxicology evidence, examining the very flypaper artefacts from the trial, which today are held in New Scotland Yard's crime museum. They also examine the forensic accountancy that surrounded the coincidental transactions between Miss Barrow and Frederick Seddon immediately prior to her death.

Season 3, Episode 08 –
Barristers Sasha Wass and Jeremy Dein investigate whether the murder of a gentleman farmer in the late Victorian era was really carried out by a 19-year-old rabbit poacher.

Staffordshire, 1893. In farmland near the sleepy village of Norton Canes, farmer William Masfen lay in wait to confront poachers who he'd been tipped off were illegally hunting on land he had rights to.

At about 3.30am, a brutal confrontation saw him shot twice and bludgeoned. Of the three injuries, any one could have killed him. His body was discovered at 9.30am, and police followed distinctive boot marks found at the crime scene to the nearby home of 19-year-old miner and renowned local poacher John Hewitt. There police found a shotgun and Hewitt's boots, which exactly matched the distinctive print. They also found a recently killed rabbit in the pantry.

Hewitt was arrested and charged with murder. He initially denied his guilt, but 48 hours after his arrest John Hewitt made a dramatic confession to police in his cell at 3.30am. He claimed that Masfen had confronted him, tried to take the gun off him, and the gun had gone off accidentally in the struggle. However, the teenager was convicted of murder in a trial that lasted just one day. He was later hanged.

Over a century later, two of John Hewitt’s descendants, Adrian and his father Trevor, are keen to find out if John might have been innocent. A family legend passed down the generations says it was actually John Hewitt's father who fired the fatal shots.

Adrian and Trevor have called on the barristers to establish if there could be any truth to the family legend. Exploring questions around the ballistics evidence given at trial, the psychological state of a 19-year-old charged with the most serious of crimes, and a confession made at the dead of night in difficult circumstances, will Jeremy and Sasha be able to find enough new evidence to cast doubt on the safety of John Hewitt's conviction?

Leading criminal barristers Sasha Wass and Jeremy Dein reinvestigate a case in which an ex-policeman was convicted and hanged for the sexually motivated killing of an 18-year-old woman on a canal towpath.

Birmingham, 1927. A young couple, Olive Turner and her boyfriend Charles Broomhead, were walking along the canal towpath in the shadows of Winson Green prison. During their walk home they were approached by someone claiming to be a policeman, who told them he would accept a bribe not to turn them in. Olive and Charles found this suspicious and made a run for it. Charles was punched and knocked out, but Olive ran off into the night chased by the supposed police officer. The following morning, Olive’s lifeless body was dragged from the canal. But was she murdered or was her death an accident?

Thirty-two-year-old factory worker James Joseph Power, who had form for impersonating a police officer, became the prime suspect and was identified during a police parade. Throughout the investigation and subsequent trial, Power always professed his innocence. He continued to do so up to his execution in 1928.

Today, James Joseph Power’s grandson Mike and his wife Sue are adamant that Power was not guilty of the crime he was convicted for, so they are bringing the case to the barristers.

Sasha and Jeremy look into the motives in this case, leading them to examine the past of James Joseph Power, the eligibility of the hastily arranged police line-up, and the pathology of the crime. Can they find anything that would lead a judge to declare Power’s conviction unsafe?

Major Armstrong claimed his wife, who had only just been discharged from a psychiatric hospital, could have killed herself by consuming the chemical he had purchased to deal with a dandelion infestation in his garden. But, despite professing his innocence, Armstrong was found guilty of killing Kitty by a jury in only three minutes. He was sentenced to death and executed.

Now, almost a century on, Kitty and Herbert’s granddaughter, Debbie, is determined to uncover the truth. Sasha and Jeremy examine forensic toxicology and nursing history in their attempt to determine whether Herbert Armstrong, believed to have been the only British lawyer to face the gallows, was wrongly convicted.
